1. Acceptance
We have created this Privacy Policy because we value users’ privacy. The Privacy Policy describes the types of information we may collect from you, or that you may provide, when you access ReviewGameZone.com (the “Site”). A New York State based LLC, owns and operates the Site. This Privacy Policy does not apply to information collected by any third party, including through any external website that may link to or be accessible from the Site. Please check directly with each such third party to avoid unfair surprises and misunderstandings.
Your use of this Site constitutes your acceptance of this Privacy Policy. If you do not agree with this Privacy Policy, you may not use our Site. This Privacy Policy may change from time to time, and the date of last update is indicated at the top of this page. Your continued use of this Site after we revise this Privacy Policy is deemed to be acceptance of the revisions, so please check this page from time to time for updates.
2. What information we collect
We collect data about your visit automatically as you navigate through the Site. We partner with selected third-party vendors (Google Analytics and StatCounter) to allow tracking technologies to, among other things, analyze and track users’ use of the Site, determine the popularity of certain content and better understand the online activity of our users while navigating our site. We have enabled IP address anonymization and disabled demographics/interest reports within the third-party vendor software. We do not transfer, provide or share any personal information you submit to this Site to these third-party vendors.
Our web servers routinely generate logs. Examples of the information we may collect include: the date, time, length of your visit, path taken through our Site, browser used, the IP address of the computer accessing our Site and any errors encountered. This information is used to monitor the functioning and integrity of the Site and is not shared with any third-party vendors.
Adults
We collect information an adult user voluntarily provides to the Site when they, among other things, contact us, create an account, post on a forum, create a support ticket, or any other situation where they willingly submit that data. We collect this information directly from them when it is provided to us.
Account Registration
a) For adult users (over the age of 18) who create an account, we store the user provided email address, password and IP address of the device used during registration. The required date of birth on the registration is only used to verify age requirements and is not stored.
b) If an adult user updates their user profile and provides us with this information, we store and make publicly viewable and searchable some or all of the following: country, state, city, job title, subject taught and grade level taught.
Test Creation / Updating Tests
a) Data can be inserted/updated in our games using our test creation form. An adult user with a validated account can upload data. During submission we collect, then display any data entered into the fields or selected from pull down menus and also upload any image(s) from upload fields to be stored on servers required for the site to function.
b) Once your data is submitted, the question, answer, images, title, description and other form entered/selected data becomes searchable by other users of the site who may create a copy of some or all of that data. Your submitted data will be displayed publicly in a manner where others will have direct viewing of the data. Search engines/web crawlers/etc. may view/copy/display your data.
c) Email, IP addresses and passwords are never displayed as a result of test creation.
Optional Track My Progress
We collect and store information if a user clicks on the “Track My Progress” tab within our games and supplies voluntary information into the text fields. Upon game completion, we collect the following in these instances: first name, last name, teacher id number, time stamp of submission, the number of individual responses and attempts at the questions. If a valid teacher id number is entered and the teacher has agreed to our user agreement, that student information will be shared and displayed for that teacher to view and analyze.
Minors
Use of any section of the Site by minors is prohibited without permission by a parent or legal guardian of the minor.
Minors under 13 years old are not permitted to submit personal information at any time to this Site.
Minors older than 13 but under 18 years old are not permitted to submit personal information at any time to this Site unless their teacher requests information to be used within the statistical collection portion of the Site by using the “Track my Progress” tab located within our games. In which case they are only allowed to submit their first name and first two letters of their last name. If the minor supplies the voluntary information into the text fields, upon game completion, we collect and store the following: first name, last name, teacher id number, time stamp of submission, the number of individual responses and attempts at the questions. If a valid teacher id number is entered and the teacher has agreed to our user agreement, that minor’s information will be shared and displayed only with that teacher to view and analyze.
This Site does not knowingly accept, print or process information submitted by minors under 13 years old, and cannot be held responsible for such actions.
PLEASE NOTE: upon giving your child consent to access the Internet; they are being exposed to certain material that may not be appropriate for children. They are also being exposed to areas where they may have communication with adults, where personal information such as phone numbers and addresses, could be voluntarily revealed. Please talk to your children about these areas, before you grant them consent. This Site cannot be held responsible for situations that arise from such situations where personal information is disclosed while using this Site.
3. How we use your information
We use information that we collect about you or that you provide to us, including any personal information:
a. To provide the services you requested.
b. To notify you about changes to our Site or any services we offer or provide though it.
c. To carry out our obligations and enforce our rights.
d. In any other way we may describe when you provide the information.
4. Disclosure of your information
All personal information collected is not shared, posted, sold, or otherwise disseminated to other third parties, unless required by law.
We may disclose personal information:
a. To fulfill the purpose for which it was provided.
b. To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of the Site's assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information about our Site users is among the assets transferred. Teacher requested student submitted data via the “Track My Progress” tab will be deleted before any site transfer.
c. We may, without restriction, disclose aggregated information about our users and information that does not identify any individual.
d. For any other purpose disclosed by us when you provide the information.
e. Any information an adult user voluntarily enters into a publicly viewable submission field within our site.
We may also disclose all personal information:
a. To comply with any court order, law or legal process, including to respond to any government or regulatory request.
b. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Site, its users or others.
5. Data Security
Personal information you provide and information automatically generated is stored on a password protected server, however, we cannot guarantee the security of your information transmitted to our Site because any transmission of information over the Internet has its inherent risks. Additionally, we cannot guarantee the security of any information (including but not limited to: user name, email address, password, name, etc.) once submitted to our servers. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site. You are responsible for keeping your login credentials, if any, confidential.
Physical Security
All personal information is stored on servers located within the United States at a location with safeguards to prevent unauthorized individuals accessing the server or its data.
Data Breach Protocol
This Site maintains a contact list of email addresses of users provided during registration. Should a data breach involving personal information occur that this Site is made aware of, those users will be notified via email as soon as it is known what breach, exposure, or data loss may have occurred.
Staff Training
This Site requires all Review Game Zone personnel who would be in direct contact with user data be trained in the secure handling and privacy distribution of data.
7. Cookies
a. Use of Cookies. Cookies are small bits of data sent from a web server to your web browser, and then stored on your hard drive. This Site uses its own cookies to save certain user entered information so it does not have to be re-entered each time requested. We also use third party cookies for statistical analysis of users. Information collected includes, but is not limited to: browser type, operating system specifications, date & time of entry and exit of site. This information is collected to make your web-surfing experience easier. This Site reserves the right to use this information in circumstances where law enforcement agencies, court orders, subpoenas, or any other circumstance that is part of a criminal investigation arises from use of this site. You have the ability to disable cookies from your web-browser. By doing this, some sections of this site may not function properly. Please note that third parties have no access to the cookies generated by our Site.
b. Advertising Cookie and Privacy Policies. We use third-party advertising companies to serve ads when you visit our website. We do not transfer, provide or share any personal information you submit to this Site to these third-party advertising companies. These companies may use information (not including your name, address, e-mail address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. If you would like more information about this practice and to know your choices about not having this information used by these companies, click here. Google, as a third party vendor, uses cookies to serve ads on your site. Google's use of the DART cookie enables it to serve ads to your users based on their visit to your sites and other sites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.
8. Accessing/Correcting your personal information
Parents have the right to review and delete any personal information that their child has submitted via the “Track My Progress” tab.
Adult users have the right to review and delete any personal information that they have submitted voluntarily to our site.
Please contact us by using the form located here to request access to, correct or delete any personal information that has been provided to us or to ask questions about this Privacy Policy. We reserve the right to refuse a request if we believe it would violate any law or cause the information to be incorrect.
9. Upgrade Transaction
We use a third-party payment processor and have access to some of the information you provide to them. That information is stored on their servers. We do not retain, have access or store any financial data (credit cards, bank accounts, security questions, passwords, etc.). We do store on our servers the email address used for payment if different then the email address used for account creation at this site.
10. Data Retention
Adult submitted data during test creation is kept on our servers until the user deletes that data. Data submitted during registration is kept until a request is received for account deletion. Other adult data voluntarily submitted by contacting us, email communications, post(s) on forum(s) on our site, creation of support ticket(s) or other methods is retained indefinitely or until that data is specifically requested to be removed by the user who submitted it. This Site reserves the right to remove any user submitted data that may volatile our terms of service agreement if discovered.
Student submitted data shall be kept no longer than necessary for the purposes for which it is being processed. The teacher requesting students to submit data via the “Track My Progress” tab can delete the data from their control panel when it is no longer necessary. Requesting teachers have an obligation to purge their data once it is no longer useful or within 1-year of last receiving student submitted data via the delete function within their control panel. This Site does not monitor student submitted data and it is the responsibility of the requesting teacher to follow this data retention policy. This Site has no obligation but reserves the right to periodically purge student submitted data from our servers.
11. Claims Against
Any claim relating to this Site shall be governed by the laws of the State of New York without regard to its conflict of law provisions.
